Careless Driving Violations in Florida

Title XXIII of the Florida Statutes pertains to Motor Vehicles, describing the disposition of traffic infractions in Chapter 318. It also explains the laws regarding State Uniform Traffic Control in Chapter 316, which lists a variety of specific traffic infractions.

According to Chapter 316, Section 1925, which details careless driving offenses:

(1)   Any person operating a vehicle upon the streets or highways within the state shall drive the same in a careful and prudent manner, having regard for the width, grade, curves, corners, traffic, and all other attendant circumstances, so as not to endanger the life, limb, or property of any person. Failure to drive in such manner shall constitute careless driving and a violation of this section.

(2)   Any person who violates this section shall be cited for a moving violation, punishable as provided in chapter 318.

Some of the penalties imposed if you are found guilty of careless driving may include fines, points on your driver’s license, and even jail time if you have accumulated a certain number of points in a given period of time. However, a knowledgeable traffic defense lawyer can assist you in avoiding some of these consequences and the coincidental issues that may arise as a result, like increases in your insurance premiums.
