Unnatural and Lascivious Conduct – Florida Statutes Section 800.02
Chapter 800 of the Florida Statutes includes a number of sections which are classified under the category of “Lewdness and Indecent Exposure.” The first crime detailed in this chapter pertains to “Unnatural and Lascivious Acts,” which are addressed in Chapter 800, Section 02.
800.02 states the following with regard to unnatural and lascivious acts:
A person who commits any unnatural and lascivious act with another person commits a misdemeanor of the second degree, punishable as provided in section 775.082 or section 775.083.
*Exception: A mother’s breastfeeding of her baby does not under any circumstance violate this section.
Unnatural and Lascivious Conduct – Potential Penalties
As provided above, any unnatural or lascivious act is considered a second degree misdemeanor under the Florida Criminal Code. As such, a conviction can mean a county jail sentence, probation, fines, and a charge on the individual’s criminal record.
Second Degree Misdemeanor Lewd or Lascivious Conduct: maximum term of 60 days in the county jail, up to 6 months of probation, and fines not to exceed $500
