Man Arrested for Alleged Battery of Boca Raton Police Officer

RomanoThe Boca Raton Police recently arrested a man after he allegedly entered a smoke shop while intoxicated, assaulted an employee, and subsequently kicked one of the Department’s officers. The defendant is now facing charges including battery, resisting arrest, and battery of a law enforcement officer.

According to officials from the Boca Raton Police Department, 21-year-old Samuel Romano is accused of entering Heritage Smoke Shop with the intention of buying “spice” and bath salts. Romano, who was believed to be intoxicated at the time, reportedly refused to leave when asked, and instead threw an open can of Red Bull at one of the employees. The employee then restrained Romano, at which time police were notified of the incident.

When officers arrived on the scene shortly thereafter at approximately 5:22 p.m., Romano allegedly began screaming insults at them and moving toward them in an aggressive manner. After they managed to handcuff him, Romano is said to have kicked one if the officers in the leg before spitting on a police car. He is now facing charges for battery, resisting arrest with violence, and battery of a law enforcement officer.

If Romano is ultimately convicted of these charges, he could be subject to serious penalties. Notably, battery charges in Florida become more serious when the alleged victim is a law enforcement officer. Under Florida Statutes Section 784.03, typical battery offenses are considered first degree misdemeanors, which are punishable by a maximum term of 1 year in the county jail and fines not to exceed $1,000.

However, offenses involving battery of a law enforcement officer are addressed by a separate statute, codified as 784.07(2). According to this section, battery of a law enforcement officer is considered a third degree felony, warranting a sentence of up to 5 years in prison, in addition to a maximum of 5 years probation, and/or fines of up to $5,000.
